VILLAGE REPRESENTATIVE ELECTION ORDINANCE - SECT 50
What is to happen if a Village Representative is determined not duly elected
(1) If, on the hearing of an election petition, the Court determines that a
person who was originally declared to have been elected as a
Village Representative for a Village at an election was not duly elected, that
person ceases to be a Village Representative for the Village and, subject to
subsection (2), a vacancy occurs in the office of village representative for
the Village from the date of the determination.
(2) If, on the hearing of an election petition, the Court determines that a
person was duly elected as a Village Representative for a Village in place of
a person that the Court has determined not to have been duly elected for the
Village at the election, the first-mentioned person becomes a
Village Representative for the Village from the date of the determination.
