VILLAGE REPRESENTATIVE ELECTION ORDINANCE - SECT 25

Number and qualifications of subscribers to a nomination form

(1) The nomination form of any person seeking nomination as a candidate for an
election for a Village shall be subscribed by at least 5 other persons each of
whom is an elector for the Village.

(2) Subject to subsection (4), an elector for a Village may subscribe only the
specified number of nomination forms as regards an election for the Village.

(3) If an elector subscribes more than the specified number of 
nomination forms in contravention of subsection (2), the elector's signature
is, subject to subsection (4), inoperative on any nomination form so
subscribed other than that specified number of nomination forms first
delivered.

(4) If an elector for a Village has subscribed a candidate's nomination form
as regards an election for the Village in accordance with this section and-

   (a)  the candidate withdraws his nomination for election under section 26;

   (b)  the Returning Officer for the Village makes a decision under
        section 27(1) that the candidate is not validly nominated for election
        for the Village; or

   (c)  the Returning Officer for the Village has made a decision under
        section 27(1) that the candidate is validly nominated for election for
        the Village, and subsequently-

        (i)    comes to the knowledge that the candidate has died and gives
               notice of the death under section 28(1); or

        (ii)   varies the decision to the effect that the candidate is not so
               validly nominated and gives notice of the variation under
               section 28(4), the elector may subscribe another nomination
               form as regards the election, and the elector's signature on
               that other nomination form is not inoperative only because the
               elector has previously subscribed the nomination form of that
               candidate.

(5) If an elector who may subscribe another nomination form under subsection
(4) subscribes more than one nomination form in contravention of that
subsection, the elector's signature is inoperative on any nomination form so
subscribed other than the one first delivered.

(6) For the avoidance of doubt, it is declared that if a person is-

   (a)  an elector for an Existing Village; and

   (b)  an elector for an Indigenous Village or a Composite Indigenous 
        Village, and the person has in one of those capacities subscribed the
        specified  number of nomination forms as regards an election for the
        Village concerned, subsection (2) shall not be construed as preventing
        the person from subscribing other nomination forms in accordance with
        this section in another of those capacities.

(7) In this section, "specified number of nomination forms"
(指明數目的提名 表格), in relation to an election for a Village,
means the number of nomination forms that is equivalent to the number of
Village  Representatives to be returned for the Village at the election.
