VILLAGE REPRESENTATIVE ELECTION ORDINANCE - SECT 15
Who is eligible to be registered as an elector
(1) Subject to this section, a person is eligible to be registered as an
elector for a Village only if-
(a) the person is already registered as an elector for the Village in the
existing final register for the Village that is in effect; or
(b) the person applies in accordance with this Ordinance or the EAC
Regulations to be registered as an elector for the Village and is
entitled to be so registered.
(2) Subsection (1)(a) does not apply in relation to the registration of a
person as an elector for a Village in the first provisional, or final,
register for the Village.
(3) A person is not, by virtue of being registered as an elector for an
Existing Village in the existing final register for the Village that is in
effect, entitled to have the person's name included as an elector for the
Village in any subsequent provisional register for the Village if the
Electoral Registration Officer is satisfied on reasonable grounds that the
person has not been a resident of the Village for the 3 years immediately
before the compilation of the register. The Electoral Registration Officer
may omit the person's name from the final register for the Village.
(4) A person is not eligible to be registered as an elector for an
Existing Village unless the person-
(a) is a resident of the Village;
(b) has been a resident of the Village for the 3 years immediately before
the date of application for registration;
(c) is an adult, or will be an adult on or before-
(i) in the case of registration in the first provisional, or final,
register for the Village, 3 June 2003;
(ii) in any other case, 20 October next following the person's
application for registration; and
(d) is a Hong Kong permanent resident.
(5) A person is not eligible to be registered as an elector for an
Indigenous Village or a Composite Indigenous Village unless the person-
(a) is an indigenous inhabitant of the Village, or a spouse or
surviving spouse of an indigenous inhabitant of the Village;
(b) is an adult, or will be an adult on or before-
(i) in the case of registration in the first provisional, or final,
register for the Village, 3 June 2003;
(ii) in any other case, 20 October next following the person's
application for registration;
(c) at the time of applying to be registered, satisfies the
Electoral Registration Officer that the person-
(i) holds an identity document; or
(ii) has- (A) applied for a new identity card; or (B) requested the
alteration of the identity card or the issue of a new
identity card, in replacement of the identity card previously
issued to the person; and
(d) at the time of applying to be registered-
(i) if the identity document held by, or previously issued to, the
person is an identity card, informs the
Electoral Registration Officer of the identifying number of the
identity card;
(ii) if the identity document held by the person is not an identity
card, provides the Electoral Registration Officer a copy of the
identity document.
(6) A person who, but for this subsection, would be eligible to be registered
as an elector for 2 or more Existing Villages may be registered for only one
of those Villages of that person's choice.
(7) A person who, but for this subsection, would be eligible to be registered
as an elector for 2 or more Indigenous Villages may be registered for only one
of those Villages of that person's choice.
(8) In subsection (7), "Indigenous Villages" (原居鄉村) includes
Composite Indigenous Villages.
