CHINESE MEDICINE ORDINANCE - SECT 7

Vacation of office

(Past version on 06/08/1999).

Where-

   (a)  a member of the Council-

        (i)    is sentenced to imprisonment, whether suspended or not, for any
               offence by any court or magistrate in Hong Kong or elsewhere;

        (ii)   is the subject of an order made under section 98; or

        (iii)  becomes bankrupt or enters into a voluntary arrangement with
               his creditors within the meaning of the Bankruptcy Ordinance (
               Cap 6); or

   (b)  the Chief Executive-

        (i)    is satisfied that a member of the Council is no longer
               ordinarily resident in Hong Kong; or

        (ii)   is of the opinion that a member of the Council is unable or
               unfit to perform his duties and exercise his powers as a member
               of the Council, the Chief Executive may declare his office as a
               member of the Council to be vacant, and shall notify the fact
               in such manner as the Chief Executive thinks fit; and upon such
               declaration the office shall become vacant.
