LONG-TERM PRISON SENTENCES REVIEW ORDINANCE - SECT 36
Suspension of operation of supervision order
(1) The Board may order the operation of a supervision order relating to a
prisoner to be suspended for a period not exceeding the unexpired term of the
order if it is satisfied that-
(a) the prisoner has failed to comply with a condition of the order; or
(b) because of the prisoner's conduct or a change of circumstances since
release-
(i) the prisoner is likely to commit an arrestable offence; or
(ii) in the case of a prisoner who has been recalled to prison under
section 37 or 38, the prisoner was at the time of recall likely
to commit an arrestable offence. This subsection is subject to
section 13 of Schedule 1.
(2) If the Board makes an order under this section in respect of a prisoner,
the Commissioner must recall the prisoner to prison to be reimprisoned there-
(a) for the period of the suspension; or
(b) for such shorter period as may be appropriate, having regard to any
remission granted in accordance with the Prisons Ordinance ( Cap 234)
in relation to the period of detention.
(3) A supervision order the operation of which has been suspended under this
section revives at the end of the period of suspension or the prisoner's
release from reimprisonment, whichever occurs first.
(4) An order suspending the operation of a supervision order does not affect
the date of expiry of the supervision order.
