DISABILITY DISCRIMINATION ORDINANCE - SECT 31
Exceptions for voluntary bodies
(1) Subject to subsection (5), this section applies to a body the activities
of which are carried on otherwise than for profit.
(2) Sections 26(1), 28 and 29 shall not be construed as rendering unlawful-
(a) the restriction of membership of any body to which this section
applies to persons without a disability (disregarding any minor
exceptions) where such restriction is reasonable having regard to the
main object of the body; or
(b) the provision of benefits, services or facilities to members of any
body to which this section applies where the membership is so
restricted, even though membership of the body is open to the public,
or to a section of the public.
(3) Nothing in section 26, 28 or 29 shall-
(a) be construed as affecting a provision to which this subsection
applies; or
(b) render unlawful an act which is done in order to give effect to such a
provision.
(4) Subsection (3) applies to a provision for conferring benefits on persons
without a disability (disregarding any benefits to persons with a disability
which are exceptional or are relatively insignificant), being a provision
which constitutes the main object of a body to which this section applies.
(5) This section shall not apply to a body whose recurrent expenditure is
funded wholly or in part by the Government. (Enacted 1995)
