Transfer of a licence

(1) Except as provided in this section a licence shall not be transferable.

(2) The Commissioner may on application in writing to him, showing sufficient
cause to his satisfaction, and on payment of the prescribed fee payable for an
application for a transfer, permit the transfer of an existing licence until
its expiration to another person, and such transfer shall be endorsed on the
licence.

(3) Where a licence is transferred under subsection (2), a reference in this
section and in sections 5, 8, 9, 10, 18, 19, 20 and 23 and in any regulation
made under section 18 to a licensee, shall be construed as a reference to the
person to whom the licence has been transferred.

(4) Where a licence is transferred under subsection (2) the Commissioner may
in respect of the licence impose any condition in addition to or instead of
any condition previously imposed by him under section 5(3).

(5) Where the Commissioner refuses to permit the transfer of a licence under
subsection (2), he shall give to the applicant, in writing, an adequate
statement of the reasons for the refusal. (Enacted 1993)
