Commencement and transfer of proceedings

COMMENCEMENT OF PROCEEDINGS

(1) Subject to subsection (2), proceedings under this Ordinance shall be
commenced in the District Court: Provided that rules of court may make
provision-

   (a)  for the transfer to the High Court of any proceedings upon the
        application of any party or at the instance of the District Court; and

   (b)  for the transfer and retransfer from the High Court of any proceedings
        to the District Court. (Amended 25 of 1998 s. 2)

(2) Applications under sections 11, 12, 13 and 23 shall be made to the court
that made the order to which the application relates: Provided that rules of
court may make provision for the transfer of applications from one court to
the other. (Added 79 of 1981 s. 7)
