Proof

(1) If in any proceedings under this Part a person is alleged to be, and there
are reasonable grounds for believing that such person may be, an
unauthorized entrant, that person shall be presumed to be such in the absence
of evidence to the contrary. (Replaced 48 of 1992 s. 12)

(2) Where a person is charged with an offence under this Part as being, and
there are reasonable grounds for believing that such person may be-

   (a)  the owner of a ship;

   (b)  the agent of the owner of a ship; or

   (c)  a member of the crew of a ship, that person shall be presumed to be
        such owner, agent or member, as the case may be, in the absence of
        evidence to the contrary. (Replaced 82 of 1993 s. 9)
